  • Your driving was impaired by illegal amounts of controlled substances, such as prescription drugs or street drugs

A first-offense DUI in Nevada is generally charged as a misdemeanor and carries an array of penalties. Penalties will be enhanced, however, if you have prior DUIs within the last seven years, if your BAC measured .18 percent or higher, or if your DUI caused serious injury or death.

First-offense DUI penalties include:

  • 2 to 6 days of jail time or 24 to 96 hours of community service
  • Fines of $400 up to $1,000, plus court costs
  • DUI school
  • A license suspension of 185 days

In cases where your BAC was .18 percent or more, additional penalties can include an alcohol or drug dependency evaluation, alcohol or drug treatment program, and an ignition interlock device requirement for your vehicle for up to 18 months.
